The cornerstone of the GUN LIST ad policies is the standard return privilege which
applies to all transactions originating in the pages of GUN LIST, with the exception of
layaways. That policy reads:
Unless stated otherwise in the ad, the buyer has five business days (M-F) to return
merchandise from the time he receives the item from an advertiser. (Return package
must be post dated no later than five business days after arrival of item to buyer’s or
FFL holder’s address). The buyer does not have to give a reason for a return and can
demand a refund less postage costs. The buyer can request, but not demand, a
replacement. If the buyers requests it, the seller must refund the purchase price rather
than issue a credit or exchange. Merchandise returned must be in the same condition
it was sent. In the event of a return, the seller may demand that the entire order, rather
than a portion, be returned for a refund. We agree to restocking fees when the sale
involves a new, in the box, firearm or if the buyer is legally unqualified to take pos-
session of the firearm. There are no returns or refunds on custom work.
In the case of firearms shipped through a third-party FFL holder, the return period
will begin the day the intermediary FFL holder receives the gun. It is the responsibili-
ty of the buyer to make arrangements to examine the gun and comply with the return
policy while the gun is in the possession of the FFL licensee when federal, state or
local laws prohibit its delivery to the buyer within the standard five-day period.
